{"id":1022,"date":"2024-11-19T10:10:38","date_gmt":"2024-11-19T10:10:38","guid":{"rendered":"https:\/\/ipfray.com\/?p=1022"},"modified":"2024-11-19T10:10:38","modified_gmt":"2024-11-19T10:10:38","slug":"upcs-milan-ld-granted-pirelli-two-ex-parte-seizures-against-rival-tire-makers-at-major-motorcycle-fair","status":"publish","type":"post","link":"https:\/\/ipfray.com\/staging1\/upcs-milan-ld-granted-pirelli-two-ex-parte-seizures-against-rival-tire-makers-at-major-motorcycle-fair\/","title":{"rendered":"UPC&#8217;s Milan LD granted Pirelli two ex parte seizures against rival tire makers at major motorcycle fair"},"content":{"rendered":"\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"border-width:1px\">\n<p class=\"wp-block-paragraph\"><strong>Context:<\/strong> In the first half of November, the Unified Patent Court (UPC) granted three patent injunctions in three different venues, three different countries and three different languages (<a href=\"https:\/\/ipfray.com\/upc-roundup-2-weeks-more-injunctions-more-opportunities-after-opt-out-withdrawal-and-a-case-that-lasted-only-one-day\/\">November 16, 2024 <strong>ip fray<\/strong> article<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What&#8217;s new:<\/strong> On November 5, 2024, the UPC&#8217;s Milan Local Division (LD) furthermore granted two <em>ex parte<\/em> seizure orders to Italian tire giant Pirelli against Chinese rivals at a major motorcycle trade show named EICMA. The patents and defendants differ between the two cases. Those orders were apparently the first ones of this kind by the Milan LD. <strong>ip fray<\/strong> has seen the orders though they had not yet been published on the UPC&#8217;s website (as of the time when this article was written) .<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Direct impact:<\/strong> The seizure orders were executed promptly. It is unclear whether those Chinese companies were actually selling those tires in Europe. The normal course of business is now for Pirelli to initiate further proceedings in which the defendants will be heard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Wider ramifications:<\/strong> Different judges made the two decisions, which are consistent in terms of outcome as well as reasoning, though they were written separately (as opposed to a copy-and-paste operation).<\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">On November 5, 2024, Presiding Judge <a href=\"https:\/\/www.unified-patent-court.org\/fr\/juridiction\/membre\/pierluigi-perrotti\">Pierluigi Perrotti<\/a>, acting as a single judge, handed down seizure order no. 59754\/2024 as requested by Pirelli Tyre s.p.a. (of Milan, Italy) against Yuanxing Rubber Co. Ltd. (of Sichuan, China) and the Automotive Council of the China Council for the Promotion of International Trade over <a href=\"https:\/\/patents.google.com\/patent\/EP3519207A1\/en?oq=ep3519207\">EP35190207<\/a> (&#8220;motorcycles tyre&#8221;). The second-named defendant organized a trade show presence for various Chinese companies at one of the leading motorcycle (and motorcycle accessory) trade fairs in the world: <a href=\"https:\/\/en.wikipedia.org\/wiki\/EICMA\">EICMA<\/a> (<strong>E<\/strong>sposizione\u00a0<strong>I<\/strong>nternazionale\u00a0<strong>C<\/strong>iclo\u00a0<strong>M<\/strong>otociclo<em> <\/em>e\u00a0<strong>A<\/strong>ccessori), which is held in Milan every year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the same day, Judge <a href=\"https:\/\/www.unified-patent-court.org\/fr\/juridiction\/membre\/alima-zana\">Alima Zana<\/a> granted Pirelli a seizure order against Kingtyre Group Co.. Ltd. of Tianjin, China, and its German subsidiary Kingtyre Deutschland GmbH over <a href=\"https:\/\/patents.google.com\/patent\/EP2519412B1\/en?oq=ep2519412\">EP2519412<\/a> (&#8220;Motorcycle tyre and pair of motorcycle tyres&#8221;).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the original <em>ex parte<\/em> motions, Pirelli&#8217;s lawyers sought <strong><em>both <\/em><\/strong>a prohibitive injunction (sales ban) <strong><em>and<\/em><\/strong> seizures of allegedly infringing products at the EICMA trade show. Both judges, however, presented them with a choice:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">maintain the request for a general injunction, in which case the non-moving parties would have to be given the chance to be heard, <strong><em>or<\/em><\/strong><\/li>\n\n\n\n<li class=\"\">narrow the prayers for relief to just seizures at the trade show, in which case the decision, in light of the sense of urgency, can be made <em>inaudita altera parte<\/em> (without hearing the other side).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pirelli opted for the latter (as Presiding Judge Perrotti&#8217;s decision explicitly notes, but <strong>ip fray<\/strong> knows that the same happened in the case before Judge Zana), and won.
