Previously, Nokia had only sued one (Western) payment terminal maker, Verifone, which they then settled in August (<a href=\"https:\/\/ipfray.com\/two-frand-firsts-for-the-upc-first-sep-settlement-nokia-verifone-first-frand-appellate-hearing-oppo-panasonic\/\" target=\"_blank\" rel=\"noreferrer noopener\">August 14, 2024 <\/a><strong><a href=\"https:\/\/ipfray.com\/two-frand-firsts-for-the-upc-first-sep-settlement-nokia-verifone-first-frand-appellate-hearing-oppo-panasonic\/\" target=\"_blank\" rel=\"noreferrer noopener\">ip fray<\/a><\/strong><a href=\"https:\/\/ipfray.com\/two-frand-firsts-for-the-upc-first-sep-settlement-nokia-verifone-first-frand-appellate-hearing-oppo-panasonic\/\" target=\"_blank\" rel=\"noreferrer noopener\"> article<\/a>). SUNMI (a Chinese POS vendor) filed an action in the Yunnan Kunming Intermediate Court seeking a global FRAND rate-setting for Nokia&#8217;s 2G, 3G, 4G cellular and 802.11 SEP portfolio in January 2025.<\/p>\n\n\n\n<p><strong>What\u2019s new:<\/strong> Nokia has filed two cases in Germany and two cases in the Unified Patent Court (UPC) in response to that action. It also requested and has since been granted anti-antisuit injunctions (AASIs) by the Regional Court of Munich and the UPC Local Division in Munich. In a statement today, it emphasized that \u201cthe companies have been in discussions for years and [Nokia] are disappointed that this matter could not be resolved amicably\u201d.<\/p>\n\n\n\n<p><strong>Direct impact:<\/strong> This marks the third AASI to be granted by the UPC \u2013 all three of which have been handed down in the Munich Local Division. The first publicly-known AASIs emerged in Huawei v. Netgear at the end of last year (<a href=\"https:\/\/ipfray.com\/upc-responds-to-first-antisuit-attack-on-its-jurisdiction-with-first-anti-antisuit-injunction-against-netgear-huawei-also-gets-one-from-munich-i-regional-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">December 23, 2024 <\/a><strong><a href=\"https:\/\/ipfray.com\/upc-responds-to-first-antisuit-attack-on-its-jurisdiction-with-first-anti-antisuit-injunction-against-netgear-huawei-also-gets-one-from-munich-i-regional-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">ip fray<\/a><\/strong><a href=\"https:\/\/ipfray.com\/upc-responds-to-first-antisuit-attack-on-its-jurisdiction-with-first-anti-antisuit-injunction-against-netgear-huawei-also-gets-one-from-munich-i-regional-court\/\" target=\"_blank\" rel=\"noreferrer noopener\"> article<\/a>). Meanwhile, last month, it was revealed that Avago (Broadcom) had actually been granted the UPC\u2019s first-ever AASI (<a href=\"https:\/\/ipfray.com\/avago-broadcom-actually-won-the-upcs-first-ever-anti-antisuit-injunction-paved-the-way-for-the-huawei-v-netgear-aasi-that-came-down-two-days-later\/\" target=\"_blank\" rel=\"noreferrer noopener\">January 16, 2025 <\/a><strong><a href=\"https:\/\/ipfray.com\/avago-broadcom-actually-won-the-upcs-first-ever-anti-antisuit-injunction-paved-the-way-for-the-huawei-v-netgear-aasi-that-came-down-two-days-later\/\" target=\"_blank\" rel=\"noreferrer noopener\">ip fray<\/a><\/strong><a href=\"https:\/\/ipfray.com\/avago-broadcom-actually-won-the-upcs-first-ever-anti-antisuit-injunction-paved-the-way-for-the-huawei-v-netgear-aasi-that-came-down-two-days-later\/\" target=\"_blank\" rel=\"noreferrer noopener\"> article<\/a>).<\/p>\n\n\n\n<p><strong>Wider ramifications:<\/strong>  The case could also have a bearing on two sets of current interim license proceedings in the England &amp; Wales Court of Appeal between Amazon and Nokia (<a href=\"https:\/\/ipfray.com\/interim-license-imperialism-lord-justice-arnold-becomes-a-threat-to-uk-relations-with-the-united-states-europe-other-countries-and-regions\/\" target=\"_blank\" rel=\"noreferrer noopener\">February 2, 2025 <\/a><strong><a href=\"https:\/\/ipfray.com\/interim-license-imperialism-lord-justice-arnold-becomes-a-threat-to-uk-relations-with-the-united-states-europe-other-countries-and-regions\/\" target=\"_blank\" rel=\"noreferrer noopener\">ip fray<\/a><\/strong><a href=\"https:\/\/ipfray.com\/interim-license-imperialism-lord-justice-arnold-becomes-a-threat-to-uk-relations-with-the-united-states-europe-other-countries-and-regions\/\" target=\"_blank\" rel=\"noreferrer noopener\"> article<\/a>) and Lenovo and Ericsson (<a href=\"https:\/\/ipfray.com\/interim-license-appeal-the-uk-could-end-up-violating-the-border-of-the-united-states-of-america-for-the-first-time-since-the-war-of-1812\/\" target=\"_blank\" rel=\"noreferrer noopener\">February 18, 2025 <\/a><strong><a href=\"https:\/\/ipfray.com\/interim-license-appeal-the-uk-could-end-up-violating-the-border-of-the-united-states-of-america-for-the-first-time-since-the-war-of-1812\/\" target=\"_blank\" rel=\"noreferrer noopener\">ip fray<\/a><\/strong><a href=\"https:\/\/ipfray.com\/interim-license-appeal-the-uk-could-end-up-violating-the-border-of-the-united-states-of-america-for-the-first-time-since-the-war-of-1812\/\" target=\"_blank\" rel=\"noreferrer noopener\"> article<\/a>). Further, it is the second to emerge in the last 24 hours in which a patent owner has sued a Chinese implementer in a court in Germany (and more specifically, Munich). Yesterday, it became known that Avanci licensor Sol IP sued Chinese automaker BYD in the Regional Court of Munich over 4G SEPs (<a href=\"https:\/\/ipfray.com\/exclusive-avanci-licensor-solip-sues-chinese-automaker-byd-in-munich-over-4g-seps-at-least-one-chinese-car-maker-is-already-licensed\/\" target=\"_blank\" rel=\"noreferrer noopener\">19 February, 2025 <\/a><strong><a href=\"https:\/\/ipfray.com\/exclusive-avanci-licensor-solip-sues-chinese-automaker-byd-in-munich-over-4g-seps-at-least-one-chinese-car-maker-is-already-licensed\/\" target=\"_blank\" rel=\"noreferrer noopener\">ip fray<\/a><\/strong><a href=\"https:\/\/ipfray.com\/exclusive-avanci-licensor-solip-sues-chinese-automaker-byd-in-munich-over-4g-seps-at-least-one-chinese-car-maker-is-already-licensed\/\" target=\"_blank\" rel=\"noreferrer noopener\"> article<\/a>).<\/p>\n<\/div>\n\n\n\n<p>China-based SUNMI was founded in 2013 as a joint venture between Xiaomi and Ant Group (formerly Ant Financial, Alibaba). Its global headquarters are in Singapore.<\/p>\n\n\n\n<p>The patents asserted include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/patents.google.com\/patent\/EP3220562A1\/en?oq=EP3220562\" target=\"_blank\" rel=\"noreferrer noopener\">EP3220562<\/a> and <a href=\"https:\/\/patents.google.com\/patent\/EP3799333A1\/en?oq=EP3799333\" target=\"_blank\" rel=\"noreferrer noopener\">EP3799333<\/a>: (\u201cAllocation of preamble sequences\u201d)<\/li>\n\n\n\n<li><a href=\"https:\/\/patents.google.com\/patent\/EP3557917B1\/en?oq=EP3557917\" target=\"_blank\" rel=\"noreferrer noopener\">EP3557917<\/a>: (\u201cMethod and apparatus for providing efficient discontinuous communication\u201d)<\/li>\n\n\n\n<li><a href=\"https:\/\/patents.google.com\/patent\/EP2243229A2\/en?oq=EP2243229\" target=\"_blank\" rel=\"noreferrer noopener\">EP2243229<\/a>: (\u201cMethod and apparatus for conveying antenna configuration information via masking\u201d)<\/li>\n<\/ul>\n\n\n\n<p>Nokia said in a statement today:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cSUNMI\u2019s point-of-sale payment devices use a mix of Nokia\u2019s patented cellular technologies and Wi-Fi standards fundamental inventions. We have been in discussions with SUNMI for several years and are disappointed that this matter could not be resolved amicably. We hope that SUNMI \u2013 like their competitors \u2013 will agree to a license on fair and reasonable terms covering the use of our technologies in their devices.\u201d<\/p>\n<\/blockquote>\n\n\n\n<div class=\"wp-block-group is-nowrap is-layout-flex wp-container-core-group-is-layout-6c531013 wp-block-group-is-layout-flex\">\n<p>This case is among several others in which one side or the other is seeking to gain a tactical advantage from decisions in one jurisdiction that derail proceedings in another. AAIs have proved effective in recent years, such as in <em>Huawei v. Netgear<\/em>.<br><br>However, so far, anti-antisuit injunctions have only related specifically to antisuit injunctions. The concept could also soon be extended to interim license requests.<br><br>Under Munich case law, the pursuit of a forcible global FRAND license on court-determined terms suggests that an antisuit injunction may be imminent. On that basis, AASIs are granted.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-text-align-center\"><blockquote><p>\u201cThe UPC&#8217;s Munich Local Division and the Munich I Regional Court have a &#8220;zero tolerance&#8221; policy when they respond forcefully to unlawful foreign interference with their cases. Lord Justice Arnold and his peers, and especially the parties who try to capitalize on outrageous UK decisions, may soon learn that lesson in connection with interim licenses. No single jurisdiction has the right to be the world&#8217;s sole FRAND forum.
