Shortly thereafter, the parties sued for peace (<em>see<\/em> item 2.2 of our <a href=\"https:\/\/ipfray.com\/upc-roundup-first-pi-affirmance-another-sep-settlement-frand-procedures-joinders-amendments-and-more\/\">September 27, 2024 Unified Patent Court (UPC) Roundup<\/a>). Two months ago, we found out that ASUS, directly and\/orindirectly, brought infringement claims agianst Xiaomi in the Landgericht M\u00fcnchen I (Munich I Regional Court) (<a href=\"https:\/\/ipfray.com\/new-sep-lawsuits-in-munich-filed-against-xiaomi-over-asustek-patents-sources\/\">February 6, 2025 <strong>ip fray<\/strong> article<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What&#8217;s new:<\/strong> Today we have discovered that OPPO and its upmarket OnePlus affiliate are now being sued in the Munich I Regional Court by ASUS and ISC. Both ASUS and ISC, as we have furthermore found out, are represented by the same licensing agent, Celerity IP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Direct impact:<\/strong> Unlike Xiaomi, OPPO left the German market (in 2022 as a result of the enforcement of a Mannheim patent injunction by Nokia), but after a string of settlements (Nokia, Philips, InterDigital and others) and litigation-free license agreements such as with Ericsson (<a href=\"https:\/\/ipfray.com\/ericsson-and-oppo-announce-license-deal-while-interdigital-unconvincingly-attempts-to-explain-away-its-uk-frand-defeat\/\">July 15, 2024 <strong>ip fray<\/strong> article<\/a>), OPPO (and OnePlus) could try to regain market share in Germany. At the moment, Deutsche Telekom (T-Mobile) offers phones from more than a dozen brands in its <a href=\"https:\/\/shop.telekom.de\/smartphones-und-handys\">online shop<\/a>, but not OPPO and OnePlus. There is litigation pending with VoiceAge EVS, and now OPPO has been sued by ASUS and ISC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Wider ramifications:<\/strong> It is interesting to see that some plaintiffs still prefer the Munich I Regional Court over the UPC for their wireless patent infringement actions. For example, two Avanci licensors are currently suing Chinese automaker BYD in the Munich I Regional Court, but not (or not yet) in the UPC (<a href=\"https:\/\/ipfray.com\/heat-turns-up-on-automaker-byd-as-avanci-licensor-ip-bridge-seeks-germany-wide-patent-injunctions\/\">April 2, 2024 <strong>ip fray<\/strong> article<\/a>).<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">ASUS cases<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\"><em>ASUS v. OPPO and OnePlus<\/em>: case no. 21 O 2344\/25 (Presiding Judge: Dr. Georg Werner)<\/li>\n\n\n\n<li class=\"\">We&#8217;re still trying to track down the SEP-in-suit and also the case number of the related Xiaomi lawsuit.<\/li>\n\n\n\n<li class=\"\">Counsel for ASUS: Arnold Ruess&#8217;s <a href=\"https:\/\/www.arnold-ruess.com\/en\/team\/dr-marina-wehler\">Dr. Marina Wehler<\/a>, <a href=\"https:\/\/www.arnold-ruess.com\/en\/team\/dr-arno-risse\">Dr.  Arno Risse<\/a> (&#8220;Ri\u00dfe&#8221; in German), <a href=\"https:\/\/www.arnold-ruess.com\/en\/team\/dr-lisa-rieth\">Dr. Lisa Rieth<\/a>, <a href=\"https:\/\/www.arnold-ruess.com\/en\/team\/julius-winkler\">Dr. Julius Winkler<\/a>, <a href=\"https:\/\/www.arnold-ruess.com\/en\/team\/victoria-thuesing\">Victoria Thuesing<\/a> (&#8220;Th\u00fcsing&#8221; in German) and <a href=\"https:\/\/www.arnold-ruess.com\/en\/team\/felix-koetterheinrich\">Felix Koetterheinrich<\/a> (&#8220;K\u00f6tterheinrich&#8221; in German), together with a Cohausz &amp; Florack team led by patent attorney <a href=\"https:\/\/www.cohausz-florack.de\/fr\/nous-sommes\/notre-equipe\/dr-christoph-walke\/\">Dr. Christoph Walke<\/a>.<\/li>\n\n\n\n<li class=\"\">OPPO and OnePlus are being defended by Taylor Wessing&#8217;s <a href=\"https:\/\/www.taylorwessing.com\/en\/people\/germany\/munich\/dr-jan-phillip-rektorschek\">Dr. Jan Phillip Rektorschek<\/a>. We&#8217;re still trying to find out who defends Xiaomi.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">ISC cases<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">The patent-in-suit against OPPO, OnePlus and (in a separate case) Xiaomi is <a href=\"https:\/\/patents.google.com\/patent\/EP2802185B1\/en?oq=EP2802185+\">EP2802185<\/a> (&#8220;Method and Apparatus for Adding Serving Cells in a Wireless Communication System&#8221;). It was previously asserted against Lenovo.<\/li>\n\n\n\n<li class=\"\">These cases, like the ASUS cases, have been assigned to the 21st Civil Chamber under Presiding Judge Dr. Georg Werner.<\/li>\n\n\n\n<li class=\"\"><em>ISC v. OPPO and OnePlus<\/em>: case no. 21 O 2342\/25<\/li>\n\n\n\n<li class=\"\"><em>ISC v.
