{"id":997,"date":"2024-11-12T15:47:22","date_gmt":"2024-11-12T15:47:22","guid":{"rendered":"https:\/\/ipfray.com\/?p=997"},"modified":"2024-11-12T15:47:22","modified_gmt":"2024-11-12T15:47:22","slug":"avanci-announces-two-new-german-aftermarket-licensees-but-not-the-most-vocal-german-would-be-licensee-continental","status":"publish","type":"post","link":"https:\/\/ipfray.com\/staging1\/avanci-announces-two-new-german-aftermarket-licensees-but-not-the-most-vocal-german-would-be-licensee-continental\/","title":{"rendered":"Avanci announces two new German aftermarket licensees, but not the most vocal German would-be licensee: Continental"},"content":{"rendered":"\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"border-width:1px\">\n<p class=\"wp-block-paragraph\"><strong>Context:<\/strong> Avanci regularly announces new licensees, such as ADS-TEC Energy, an electric-vehicle charger maker (<a href=\"https:\/\/ipfray.com\/avanci-signs-up-another-ev-charger-licensee-like-most-sep-licensing-this-happened-without-litigation\/\">October 31, 2024 <strong>ip fray<\/strong> article<\/a>), and new licensors, such as SOLiD (<a href=\"https:\/\/www.linkedin.com\/posts\/avanci-company_ip-5g-patentlicensing-activity-7261749532281978880-9R8e\/?utm_source=share&amp;utm_medium=member_desktop\">November 11, 2024 LinkedIn post by Avanci<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What&#8217;s new:<\/strong> Avanci&#8217;s Aftermarket program, which launched in early 2023 and covers certain types of devices (monitoring, infotainment and other multi-function products) that are not pre-installed when connected cars ship, has now been joined by two German makers of ticketing solutions, <a href=\"https:\/\/www.krauth-technology.de\/en\/\">krauth technology GmbH<\/a> (from the Heidelberg area) and <a href=\"https:\/\/www.systemtechnik-online.de\/\">Systemtechnik GmbH<\/a> (from the East German state of Thuringia) (<a href=\"https:\/\/www.linkedin.com\/posts\/avanci-company_ip-patentlicensing-innovation-activity-7262094305610129409-IQvP\/?utm_source=share&amp;utm_medium=member_desktop\">November 12, 2024 LinkedIn post by Avanci<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Direct impact:<\/strong> Avanci Aftermarket now has 9 licensees and 47 licensors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Wider ramifications:<\/strong> When reading about German Avanci Aftermarket licensees, readers familiar with that market might have intuitively thought that one of them would be Continental, a company that unsuccessfully sued Avanci for a component-level license in the U.S., followed by a Delaware state lawsuit against Avanci licensor Nokia that in some ways represented a rehash of the federal lawsuit against Avanci itself, but went nowhere (<a href=\"https:\/\/ipfray.com\/continental-withdraws-delaware-lawsuit-against-nokia-over-sep-licensing-in-auto-industry-another-one-bites-the-dust\/\">July 18, 2024 <strong>ip fray<\/strong> article<\/a>). Continental makes not only telecommunications control units (TCUs) that are incorporated into cars but also aftermarket products such as fleet management solutions (<a href=\"https:\/\/www.continental-mobility-services.com\/en-en\">Continental website<\/a>). It is notably absent from Avanci Aftermarket&#8217;s list of licensees.<\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Avanci&#8217;s LinkedIn post about the two new German licensees contains a quote from Qudus Olaniran, Vice President of Avanci Aftermarket:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Adding Krauth Technology and Systemtechnik strengthens our Avanci Aftermarket program. We&#8217;re excited to work with both companies, alongside our existing participants, as the rapid growth of this program continues.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Given that this program has been around for more than 20 months and that Continental has been saying publicly for more than five years that it needs standard-essential patent (SEP) licenses to have freedom to operate, the question is why they haven&#8217;t taken a license covering their aftermarket products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company colloquially referred to as Conti remains very active in SEP policy. It regularly participates in different events where it voices its demands for exhaustive component-level SEP licenses, and has recently started sponsoring an Apple-led astoturfing operation that absurdly claims to defend the interests of small and medium-sized app developers and IoT product makers when engaging in lobbying with respect to automotive SEP licensing (<a href=\"https:\/\/ipfray.com\/apple-may-finally-have-reduced-financial-commitment-to-act-but-its-sme-astroturfing-on-sep-policy-continues\/\">September 12, 2024 <strong>ip fray<\/strong> article<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some SEP holders are known to be prepared to license component makers. Such deals have happened, and have in fact been announced. But to date not a single license deal between Conti and a cellular SEP holder has become known, regardless of product category. If Conti wanted, they could get 47 SEP licenses for their aftermarket products in one fell swoop. But they haven&#8217;t taken an Avanci Aftermarket license, nor has there ever been any announcement of a bilateral license. Is Conti just talking the talk, but not walking the walk?
