UPC’s Court of Appeal opens door to more cases: opt-out can be withdrawn even if pre-UPC national lawsuit over same patent is still pending
The Unifed Patent Court’s Court of Appeal has now invited patent holders to withdraw opt-outs and sue in the UPC even if they brought litigation in national courts prior to the start of the UPC.
