UPC’s CD Munich: co-inventorship is not enough to revoke a patent for lack of entitlement
The CD Munich held that Art. 138(1)(e) EPC requires proof that the proprietor has no rights at all, so demonstrating co-inventorship cannot support revocation. The wind turbine patent is maintained as amended, less two dependent claims held insufficiently disclosed.
