Context: Wireless Future Technologies, Inc., a Canadian patent assertion entity (PAE) and direct subsidiary of WiLAN Inc., holds a vast portfolio of standard-essential patents (SEPs) related to core infrastructure for 3G, 4G LTE, and 5G mobile communications. Wireless Future Technologies sued Spanish telecommunications network operator Telefónica, its first suit of this kind, in the Mannheim Regional Court. The plaintiff alleged both direct and indirect infringement through its LTE-enabled base stations, which were originally manufactured by Huawei, covering configurations both before and after a software update implemented around January 20, 2024. But in a first-instance decision in 2024, the Mannheim Regional Court found no evidence of infringement, dismissing the PAE’s case. Wireless Future Technologies filed an appeal in the Higher Regional Court of Karlsruhe in March 2024. A hearing was held on July 6, 2026.
