Abbott wins another UPC PI against glucose sensor rival Sibio

Context: Continuous glucose monitoring (CGM) market leader Abbott Diabetes Care has been embroiled in a patent licensing dispute with Chinese rival Sibio Technology since March 2024, when it first filed an application for a preliminary injunction (PI) in the UPC’s Local Division (LD) in The Hague for the alleged infringement of EP831283 (“Analyte sensor devices, connections, and methods”). The company has already won various injunctions against opponents in the UPC, including in parallel cases against Sinocare (October 17, 2025 ip fray article) and MicroTech Medical. It obtained its first PI against Sibio in February 2025, when the UPC’s Court of Appeal (CoA) reversed a Hague Local Division (LD) refusal (February 19, 2025 ip fray article). In March, Abbott filed a new application for provisional measures in the UPC’s Milan LD, alleging that another one of its patents was being infringed by a separate Sibio product: a device named GS3-R System. A hearing was held on the provisional measures on July 14, 2026. One of the key issues raised was whether Sibio’s late-presented claim construction arguments, specifically about claim 1.6 of the patent-in-suit, should be admitted.
