BlackBerry acquires Google patents, reports “stronger than expected” licensing revenue

Context: After exiting the mobile device industry years ago, BlackBerry has become a more active monetizer of its vast patent portfolio; most notably, selling approximately 32,000 assets to patent assertion entity (PAE) Malikie Innovations (March 21, 2023 Reuters article).

The “trigger event” which brings the LOT Network license into force is an assignment to an “Assertion Entity”, which LOT defines as an entity which “collectively derived from patent assertion more than half of their total consolidated gross revenue measured over the full 12 months preceding a particular date”. BlackBerry does not appear to meet that definition; so in the event it, or a subsequent assignee that does meet the definition, asserted patents acquired from one LOT member against another LOT member, it isn’t immediately clear if and when the license would be triggered. ↩︎
