Delhi High Court orders Rosenberger to pay $17.7 million in damages, upholds rival antenna patent

Context: In 2012, Canadian company Communication Components Antenna Inc. (CCA) acquired Indian Patent No. 240893 (IN’893) titled “Asymmetrical Beams For Spectrum Efficiency” from its predecessor-in-interest, TenXc Wireless Inc., which had been granted the patent in 2010. The patent relates to split-sector antennas that use asymmetrical beams to increase subscriber capacity in cellular networks without changing the existing tower footprint. CCA subsequently sued antenna maker Rosenberger and its subsidiaries for infringement, filing the present suit in December 2019 after nearly three years of unsuccessful licensing negotiations.

What’s new: In a comprehensive judgment dated March 30, 2026, Justice Prathiba M. Singh of the Delhi High Court (HC) ruled that Rosenberger’s multi-beam antennas infringe CCA’s patent. The Delhi HC rejected Rosenberger’s counterclaim seeking revocation of IN’893, holding that the patent was valid and that the defendants failed to prove any ground of invalidity. The court awarded damages of ₹152.32 crores (approximately $17.7 million).

Direct impact: The ruling issues a permanent injunction against the Rosenberger Group and establishes that comparable royalty agreements serve as the benchmark for damages in non-Standard-essential patent (SEP) cases. Defendants who engage in prolonged negotiations here spanning from 2016 to 2019 will not benefit from a favorable damages calculation; the court applied a 20% royalty rate.
