InterDigital wins Brazilian PI against Transsion over two 5G SEPs: court-appointed expert report confirmed essentiality, FRAND compliance of offer

First expert review confirming bilateral FRAND offer. First Brazilian-merits based PI over cellular SEPs.

Context:

  • Last year, research and licensing firm InterDigital started cellular standard-essential patent (SEP) enforcement actions against China-based Transsion, the African market leader and a major player in other price-sensitive markets such as Latin America (October 31, 2025 ip fray article).
  • Brazil has become one of the world’s most important SEP infringement jurisdictions.

What’s new: Today, InterDigital announced that it has won a Brazilian preliminary injunction (PI) over two 5G SEPs, as a result of which “Transsion is prevented from selling 5G-compliant devices in Brazil”. The Rio de Janeiro State Court granted the dual PI based on an expert report determining that both patents-in-suit are essential to the 5G standard and that InterDigital’s royalty demand is fair, reasonable, and non-discriminatory (FRAND).
