InterDigital wins third Munich injunction against Disney: court confirms bench ruling over HEVC-related patent

Context:

  • Research and licensing firm InterDigital has already won two Munich injunctions against The Walt Disney Company’s German streaming services, one of which is clearly making an impact as Disney prefers alienating customers over accepting InterDigital’s offer (January 23, 2026 ip fray article).
  • InterDigital is making headway against Amazon’s streaming services as well. It became clear at a London hearing yesterday that an order by the Unified Patent Court’s (UPC) Mannheim Local Division (LD) has Amazon concerned and is starting to impact UK case management (February 12, 2026 ip fray article). Amazon asserted that InterDigital is seeking video patent royalties of $200M+ a year, which InterDigital disputed without stating an alternative number in public (another February 12, 2026 ip fray article).
  • Last week, the Munich court entered a high-profile injunction from the bench, as it previously did in some other cases. Renault is now trying to thwart Broadcom’s enforcement of a standard-essential patent (SEP) relating to Ethernet (February 10, 2026 ip fray article).
  • Another SEP bench ruling came down in Munich on Wednesday, but at the UPC’s Munich LD (February 12, 2026 ip fray article).
  • This is generally a good week for patent injunctions in Germany-based courts: the UPC’s Dusseldorf LD granted a preliminary injunction over orthodontic aligners (February 12, 2026 ip fray article) and a permanent injunction over printer cartridges (another February 12, 2026 ip fray article).

Three or more German patent injunctions in a single campaign are rare even in campaigns interspersed with losses: Apple won three (non-SEP) injunctions against Motorola, Nokia five (partly SEP, partly non-SEP) injunctions against OPPO, and Nokia won four non-SEP injunctions against HTC, but all of those were “you win some, you lose some” scenarios (for example, Nokia lost about a dozen cases against HTC before the first win).
