10. Around the court: divergent win rates in Munich LD

Recent rulings at the Munich LD highlight a growing disparity between its two panels, with patentees achieving significantly fewer successes before the second panel than the first. Several recent cases were dismissed by the second panel, leading practitioners to describe the assignment of cases in Munich as a “lottery.” Observers attribute the gap largely to case-management practices. Unlike many UPC panels, it is reported the second panel skips interim conferences and provides limited pretrial guidance, making it harder to obtain evidence and establish infringement. The resulting delays and procedural hurdles are prompting some patent owners to consider filing in other UPC divisions or national courts instead of Munich.
