The appeals court also issued a clarification on enforcement security that suggests Renault had not done its homework in the first-instance proceedings. Meanwhile, it appears that another automaker has settled with Broadcom.
Context:
- Broadcom is more profitable and by far more valuable company than any other with an active patent licensing and enforcement program (February 7, 2026 ip fray article).
- Earlier this year, the Landgericht München I (Munich I Regional Court) granted Broadcom an injunction against Renault over the infringement of an Ethernet (wired network) standard-essential patent (SEP) by two very popular car models, the Renault Mégane and the Renault Clio (February 6, 2026 ip fray article). Renault appealed to the Oberlandesgericht München (Munich Higher Regional Court), and asked that court to stay the enforcement of the injunction and to raise the security amount. Last month, the appeals court postponed its ruling on those motions (March 12, 2026 ip fray article). As we noted at the time, it appeared that the injunction was not being enforced. However, there have since been rumors of a motion for contempt-of-court sanctions, which (if confirmed) would suggest that enforcement has begun, but Renault has surprisingly refused to comply.
What’s new: Today, the regional appeals court has had a mix of bad and discouraging news for Renault on multiple fronts, making it hard for Renault to refuse to settle at this stage:
