New Munich FRAND guidelines bless Avanci 5G terms: balanced analysis shows why Tesla may not save royalties through UK litigation

Context:

  • The Landgericht MĂĽnchen I (Munich I Regional Court) received more than 330 patent infringement actions last year and is on track to reach a similar level this year (July 28, 2026 ip fray article). What’s new: In its new FRAND guidelines that issued yesterday, the Munich I Regional Court’s 7th Civil Chamber has addressed a variety of issues, some of which we’ll discuss separately. A noteworthy section discusses Avanci’s 5G automotive pool and finds that its per-vehicle rate is in the market.

Direct impact: Avanci 5G licensors suing automakers in the Munich I Regional Court will have a FRAND cakewalk if their cases are assigned to the 7th Civil Chamber and pretty good chances of the 21st Civil Chamber, while independent, reaching consistent conclusions on the same set of issues, given similarities in judicial philosophy and case law.

Wider ramifications: The Avanci-related passage of the new Munich guidelines is concise and not formally binding, but provides a preview of some of the major hurdles Tesla will have to overcome in the further UK proceedings, such as Avanci’s market acceptance and reasons capable of justifying differences between automotive and mobile-device licensing, such as a longer lifespan and the exploitation through data aggregation.

Soweit ersichtlich, waren die Hintergründe dieser Streitigkeiten jedoch nicht die reine Höhe der Forderung, sondern die konkrete Vertragsstruktur von Automobilherstellern und Zulieferern.
200 Die geforderte Rate hält auch einer Überprüfung nach dem Top-Down-Approach stand. Es ist vielmehr so, dass es erhebliche Anzeichen gibt, dass auch der AVANCI Pool das Lizenzierungspotential des Portfolios nicht ausschöpft.

201 Eine erste Annäherung an die geforderten 32 US$ führt zu einem Vergleich mit dem Preis einer 5G-Lizenz für ein Mobiltelefon. 204 Zudem wäre aus zusätzlicher Gesichtspunkt neben dem Kriterium der längeren Nutzungsdauer auch auf den Gesichtspunkt der durch die lizenzierte Technik ermöglichten Einsparmöglichkeiten (Effizienzgewinne) einzugehen. 205 Unter dem Gesichtspunkt der Kommerzialisierbarkeit könnte auch diskutiert werden, ob die zeitnahe Übertragung von Nutzerdaten für die Automobilhersteller einen zusätzlichen Wert darstellt. Auch dies kann einen der Lizenzberechnung zu Grunde zu legenden Wert darstellen. Insofern wäre eine Folgeüberlegung, ob grundsätzlich ein Lizenzmodell möglich wäre, welches eine Einmalzahlung für bestimmte Nutzungen mit einem zeitabhängigen Element für andere Nutzungen kombiniert.
